1. Acceptance of Terms

Welcome to Acquire Estate. By accessing or using the Acquire Estate website at acquirestate.com (the "Platform"), registering an account, posting a property listing, browsing property information, using our tools (Loan Calculator, Area Converter), or otherwise engaging with any of our services, you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Acquire Estate.If you do not agree to all of these Terms, you must immediately discontinue your use of the Platform. These Terms apply to all users including buyers, sellers, landlords, tenants, investors, channel partners, and any other visitors.

2. About the Platform

Acquire Estate is a data-driven online real estate aggregating platform that connects property buyers, sellers, landlords, tenants, investors, and channel partners across India — with a primary focus on the Tricity region comprising Mohali, Chandigarh, Zirakpur, Panchkula, Dera Bassi, Kharar, Kurali, and New Chandigarh.

The Platform facilitates:

  • Browsing and searching verified property listings (residential flats, villas, plots, houses, and commercial properties)

  • Posting properties for sale or rent, free of charge

  • Connecting buyers and investors with verified real estate projects

  • Providing tools such as a Loan Calculator and Area Converter for informational use

  • Enabling channel partner registrations and collaboration

  • Sharing real estate news, guides, and blog content

Acquire Estate acts as an intermediary aggregator and is NOT a party to any property transaction between buyers, sellers, landlords, or tenants.

3. Eligibility and User Accounts

3.1 Eligibility

You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872, to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

3.2 Account Registration

Certain features of the Platform — including posting property listings, saving to wishlist, and accessing the account dashboard — require registration. When registering, you agree to:

  • Provide accurate, complete, and current information (name, email, phone number)

  • Maintain the security of your password and restrict access to your account

  • Notify Acquire Estate immediately of any unauthorised use of your account

  • Accept responsibility for all activities that occur under your account

3.3 Account Termination

Acquire Estate reserves the right to suspend or permanently terminate any account that violates these Terms, submits false or fraudulent information, or engages in conduct that is harmful to other users or the Platform.

4. Property Listings

4.1 Listing Submissions by Users

Users may post property listings on the Platform free of charge. By submitting a listing, you represent and warrant that:

  • You are the legal owner of the property or are duly authorised to list it on behalf of the owner

  • All information provided in the listing — including price, description, photographs, location, floor plans, and amenities — is accurate, truthful, and not misleading

  • The property is free from undisclosed legal disputes, encumbrances, or title defects to the best of your knowledge

  • You have obtained all necessary RERA registrations and regulatory approvals required under applicable law

  • You will promptly update or remove listings once a property is sold, rented, or no longer available

4.2 Verification by Acquire Estate

Acquire Estate endeavours to verify listings for RERA registration, property documents, land records, ownership history, and other red flags before publishing. However, this verification process is a reasonable-effort exercise and does not constitute a guarantee of accuracy, legal title, or physical condition of any property.

Users are strongly advised to independently verify all property details, engage qualified legal counsel, and conduct thorough due diligence before completing any transaction.

4.3 Platform Rights Over Listings

By submitting a listing, you grant Acquire Estate a non-exclusive, royalty-free, worldwide licence to display, reproduce, adapt, and promote the listing content (including photographs and descriptions) on the Platform and across its marketing channels for the purpose of connecting you with prospective buyers or tenants.

4.4 Prohibited Listings

The following are strictly prohibited on the Platform:

  • Fake, duplicate, or fraudulent property listings

  • Properties without valid RERA registration where mandatorily required under RERA Act, 2016

  • Listings with misleading or manipulated photographs

  • Properties involved in active legal disputes without disclosure

  • Properties located in illegally developed layouts or unapproved colonies

5. User Conduct and Prohibited Activities

You agree not to use the Platform for any unlawful or prohibited purpose. Specifically, you must not:

  • Use the Platform to commit fraud, misrepresentation, or any deceptive practice

  • Harvest, scrape, or systematically extract data from the Platform without prior written permission

  • Introduce any virus, malware, or harmful code into the Platform or its systems

  • Attempt to gain unauthorised access to any account, server, or database connected to the Platform

  • Post spam, unsolicited communications, or irrelevant content

  • Use the Platform for money laundering, wire fraud, or any financial crime

  • Impersonate another person, entity, or property owner

  • List properties that you do not own or are not authorised to list

  • Engage in multiple registrations or creation of fake accounts

Acquire Estate reserves the right to remove any content and restrict any user account that violates these prohibitions, without prior notice or liability.

6. Disclaimer of Warranties and Informational Nature of Content

ALL CONTENT ON THE PLATFORM — including property listings, pricing information, project details, location data, investment projections, amenity descriptions, area measurements, and blog articles — IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, FOR INFORMATIONAL PURPOSES ONLY.

Acquire Estate does not guarantee:

  • The accuracy, completeness, or currency of any listing or property information

  • That a property's stated price reflects its actual market value

  • That the completion timeline of any under-construction project will be met

  • That projected investment returns (including projected value appreciation percentages) will be realised

  • The physical condition, structural integrity, or habitability of any listed property

NOTHING ON THIS PLATFORM CONSTITUTES AN OFFER TO SELL, A SOLICITATION, LEGAL ADVICE, FINANCIAL ADVICE, OR A RECOMMENDATION TO PURCHASE OR INVEST IN ANY PROPERTY. Users should seek independent legal, financial, and technical advice before entering into any property transaction.

7. Financial and Calculation Tools

The Loan Calculator and Area Converter tools available on the Platform are provided solely for general reference and convenience. Results generated by these tools are approximate and may not reflect actual loan eligibility, applicable interest rates, or precise area measurements.

Acquire Estate is not a bank, financial institution, mortgage broker, or investment advisor. Loan Calculator results do not constitute a loan offer, pre-approval, or guarantee of financing. Users must consult their respective financial institutions and advisors for actual loan assessments.

8. Channel Partners

Acquire Estate invites real estate professionals, agents, and brokers to become channel partners. Channel partners who register on the Platform agree to:

  • Represent properties accurately and ethically to prospective buyers and investors

  • Comply with all applicable laws, including the Real Estate (Regulation and Development) Act, 2016 (RERA)

  • Not engage in any double-dealing, bribery, or fraudulent conduct in connection with transactions facilitated through the Platform

  • Maintain valid licences and registrations as required by applicable law

Acquire Estate reserves the right to terminate any channel partner relationship if the partner engages in conduct inconsistent with the Platform's values or these Terms.

9. Intellectual Property

All content on the Platform — including but not limited to the Acquire Estate name, logo, brand identity, website design, software code, text, graphics, icons, images, blog content, and data compilations — is the exclusive intellectual property of Acquire Estate and is protected under applicable Indian and international intellectual property laws.

You may not copy, reproduce, distribute, republish, display, or create derivative works from any Platform content without the express prior written consent of Acquire Estate. Property photographs submitted by listing owners remain the property of their respective owners; by submitting them, you grant Acquire Estate the limited licence described in Section 4.3.

10. Privacy and Data Collection

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, processing, and use of your personal data as described in our Privacy Policy, available at acquirestate.com/privacy-policy.

Acquire Estate collects personal information including your name, email address, phone number, and usage data to:

  • Create and manage your user account

  • Connect you with relevant property listings and sellers

  • Send newsletters, property alerts, and promotional communications (which you may opt out of at any time)

  • Improve the Platform's functionality and user experience

11. Limitation of Liability

To the fullest extent permitted by applicable law, Acquire Estate, its directors, officers, employees, affiliates, agents, and partners shall not be liable for:

  • Any loss or damage arising from your reliance on any property listing, pricing, or information published on the Platform

  • Any financial loss, including loss of investment, deposit forfeiture, or loan penalties, arising from a property transaction facilitated through the Platform

  • Any fraud, misrepresentation, or breach of contract by a seller, landlord, buyer, tenant, or third party

  • Delays in project completion, builder insolvency, or regulatory cancellations affecting any listed project

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform

  • Any interruption, suspension, or technical failure of the Platform

In no event shall Acquire Estate's aggregate liability to any user exceed the amount, if any, paid by that user to Acquire Estate in the twelve (12) months preceding the relevant claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Acquire Estate and its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your breach of these Terms

  • Any false, inaccurate, or misleading information submitted by you on the Platform

  • Your violation of any applicable law, regulation, or third-party rights

  • Any dispute between you and another user, buyer, seller, landlord, or tenant

13. Third-Party Links and Content

The Platform may contain links to third-party websites, WhatsApp contact links, Google Maps, social media profiles, and other external services. These links are provided for convenience only. Acquire Estate does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website or service.

Your interactions with third-party platforms are governed by those platforms' own terms and policies. Acquire Estate is not liable for any loss or damage arising from your use of third-party services.

14. RERA Compliance Notice

Acquire Estate encourages and, where required, mandates compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA) by all developers, builders, and sellers listing projects on the Platform. Users are advised to:

  • Verify the RERA registration number of any project before booking or investing

  • Visit the official RERA portal of the relevant state (e.g., RERA Punjab, Haryana RERA) to check registration status and project details

  • Not rely solely on the RERA status displayed on the Platform, as regulatory records may be updated independently

Acquire Estate's display of RERA information is for convenience only and does not substitute for independent verification with the relevant state RERA authority.

15. Modifications to Terms

Acquire Estate reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Updated Terms will be published on the Platform with a revised Effective Date. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes.

We encourage you to review these Terms periodically. If you do not agree with the revised Terms, you must discontinue your use of the Platform.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or any services provided by Acquire Estate shall be subject to the exclusive jurisdiction of the competent courts located in Punjab (Mohali), India.

Before initiating formal legal proceedings, users agree to first attempt to resolve any dispute with Acquire Estate through good-faith negotiation by contacting us at contact@acquirestate.com.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Acquire Estate with respect to your use of the Platform and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

Acquire Estate's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without Acquire Estate's prior written consent. Acquire Estate may freely assign these Terms.

17.5 Force Majeure

Acquire Estate shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.
